NZ RVA Succeeds in High
Court Action on Code of Practice
Our
court action against the Minister of Building and
Construction has been successful, with the High Court
ruling (on December 19) that the entire Retirement
Villages Code of Practice is invalid.
The Judge’s Decision
The
Court held that the Minister did not have the power to
unilaterally amend the draft code, and any changes
required the consent of the RVA which was not obtained.
The
Court also concluded that there was a failure, by the
Minister and the officials, to consult the RVA over the
changes to the Code, including on the very late
insertion of the retrospective “fair wear and tear”
provision, removing the right of operators to recover
this from existing contracts...more... |
